2 Red Lake Code of Tribal Offenses shall be sentenced to imprisonment for a period not to exceed six months or to a fine not to exceed $360.00 or to both such imprisonment and fine with cost. Penalty imposed to be determined by the nature of the offense. Section 61 - Setting Fires or Burning Without a Permit Any Indian who shall set on fire any timber, underbrush, grass, or other flammable material, endangering any forest, without first obtaining a burning permit, upon the Red Lake Indian Reservation, shall be deemed guilty of an offense and upon conviction thereof, shall be sentenced to imprisonment for a period not to exceed three months or to a fine not to exceed $180.00 or to both such imprisonment and fine with cost. Penalty imposed to be determined by the nature of the offense. Section 62 - Sale of Mortgaged Property or Property Covered by Lien Any Indian who shall knowingly sell, trade, or otherwise dispose of property that is mortgaged or covered by a lien shall be deemed guilty of an offense and upon conviction thereof shall be sentenced to imprisonment for a period not to exceed six months or to a fine not to exceed $360.00 or to both such imprisonment and fine with cost. Section 63 - Towing or Hitching Rides Any Indian who shall knowingly permit any person to hitch a toboggan, hand sled, bicycle or similar device onto any motor vehicle while being used on a street or highway on the Red Lake Indian Reservation or any Indian who shall hitch a toboggan, hand sled, bicycle, or a similar device behind a motor vehicle on this reservation, shall be deemed guilty of an offense and upon conviction thereof shall be sentenced to imprisonment for a period not to exceed thirty days or to a fine not to exceed $60.00 or to both such imprisonment and fine with cost. The law enforcement officers shall seize any toboggan, hand sled, bicycle or other device, and the court may order confiscation when used in violation of this section. |
