2 Red Lake Code of Tribal Offenses under the laws of Minnesota shall be punished in accordance with the provisions of the specific Minnesota law applied in Indian Court. Section 38 - Giving Venereal Disease to Another Any Indian who shall infect another person with a venereal disease shall be deemed guilty of an offense, and upon conviction thereof shall be sentenced to imprisonment for a period not to exceed three months, or to a fine not to exceed $180.00 or to both such imprisonment and fine with cost. The Red Lake Indian Court shall have the authority to order and compel the medical examination and treatment of any person charged with violation of this section or found to be afflicted with any communicable disease of this nature. Section 39 - Illegal Sale of Trust or Restricted Property Any Indian who sells, trades, transfers or in any way disposes of any trust or restricted property, and in the case of livestock and increase therefrom, in violation of the Government regulations and without the proper permit, shall be deemed guilty of an offense and upon conviction thereof, shall be sentenced to imprisonment for a period not to exceed six months or to a fine not to exceed $360.00 or to both such imprisonment and fine with cost. Where an indebtedness exists by the offender to the Tribe or the United States under a loan agreement, the Court may order such property, upon its recovery, sold and the proceeds applied on the indebtedness. Penalty imposed to be determined by the nature of the offense. |
