The term "transient merchant" includes any person, individual, partnership and corporation, both as principal and agent, who engage in, do, or transact any temporary and transient business within the Red Lake Indian Reservation, either in one locality, or in traveling from place to place, selling goods, wares and merchandise.
It shall be unlawful for any transient merchant to engage in, do or transact any business within the Red Lake Indian Reservation without first having obtained a license as hereinafter provided.
Subdivision 1. Application Procedure. Any transient merchant desiring to engage in, do or transact business by auction or otherwise within the Red Lake Indian Reservation shall file an application for a license for that purpose with the Treasurer of the Red Lake Band of Chippewa Indians. The application shall state the name of the applicant, the proposed place of business, the nature of the proposed business, and the length of time the applicant desires to conduct the business.
Subdivision 2. The transient merchant shall pay to the Treasurer of the Red Lake Band of Chippewa Indians a license fee of $75.00. Upon payment of such fee, the Treasurer of the Red Lake Band of Chippewa Indians shall issue to such transient merchant a license to do business. The license shall state the location of the business and the nature of the business to be conducted.
Subdivision 3. The license shall be good for a period of one (1) year from the date of its issuance. No license shall be good for more than one person, unless such person is a member of a partnership.
Subdivision 4. Prior to the issuance of the license, the applicant shall in writing consent to the jurisdiction of the Red Lake Band of Chippewa Indians over him with regard to any action commenced against the applicant arising out of any sale for which the license was granted. Any action shall be brought on the Red Lake Indian Reservation.
The provisions of Sections 1200.02 to 1200.06 shall not apply to public officers selling goods, wares and merchandise according to law nor to persons who may sell or peddle the products of the farm, garden or wilds occupied, cultivated or harvested by them; nor to the person who may sell or peddle a product or craft produced or made by him.
All license fees collected under this chapter shall be paid to the Red Lake Band of Chippewa Indians.
Every person who shall engage in, do or transact any business as a transient merchant within the Red Lake Indian Reservation without having first obtained a license shall be guilty of a gross misdemeanor.
