1 Rules of Court b.
All persons present in the Court Room shall be required to remove their
hats before Court is opened and no smoking shall be permitted during
the Court sessions.
c. After Court is formally opened, the Judge shall determine what cases are pending and issue such orders and instructions as may be required for the prompt dispatch of business pending before the Court. d. The Clerk shall direct the defendant to come forward and stand before the Judge and either the Clerk or some person designated by the Judge to act as such Clerk shall read the complaint to the defendant. Specific attention shall be given to determine whether the person before the Judge is the person named in the complaint. e. After the reading of the complaint, the Judge shall inquire whether or not the defendant understands the contents of the complaint read to hi and if he does not so understand, the Judge shall make such explanation as may be necessary for the defendant to fully understand the nature of the charge being made. f. The Judge shall then inquire of the defendant whether he is guilty or not guilty of the offense charge in the complaint. g. If a plea of guilty is made by defendant, the Judge shall make inquiry of the complaining witnesses, arresting officers, or other individuals having knowledge of the pertinent facts as to the circumstances surrounding the commission of the offense charged, the previous record of the defendant. The Judge shall also make inquiry concerning the health of the defendant, his or her family status, defendant's income, defendant's record of employment and all such other matters as may assist the Judge in reaching a conclusion on which to base the imposition of a fair and just sentence.
